Benton County Clerk Death Records Office

In Benton County, vital records are handled by the County Clerk rather than a county health department. This is not common across Missouri, and it's the first thing to know before you start searching. The Benton County Clerk office is at P.O. Box 1238, Warsaw, MO 65355. Phone is (660) 438-7326. The fee is $13 per certified copy of a death certificate. For hours, current procedures, and any updates to the mailing address, visit bentoncountymo.com. To request a certified copy in person, bring a valid photo ID and a completed Application for Missouri Vital Record. Acceptable photo IDs include a driver's license, state ID card, U.S. passport, or military ID. If you don't have a primary photo ID, two alternate documents can substitute. Alternates include Social Security cards, W-2 forms, utility bills, court papers, or letters from government agencies.

Mail requests to the Benton County Clerk must include a notarized application, a self-addressed stamped envelope, and a check or money order. Notarization is required for all mail-in requests. The clerk's office typically processes mail orders faster than the state Bureau in Jefferson City, making it a good option for recent deaths when you can't visit in person.

The Missouri Bureau of Vital Records ordering page explains the statewide process for requesting death certificates by mail or online, including the downloadable application form used by all Missouri offices.

Missouri Bureau of Vital Records and Benton County Deaths

The Missouri Bureau of Vital Records at 930 Wildwood Drive, Jefferson City, MO 65109 holds Benton County death records from January 1, 1910, through the present. Phone is 573-751-6387. Lobby hours are Monday through Friday, 9:00 AM to 3:00 PM. Appointments are recommended. For deaths before 1980, the state Bureau is often the best starting point because older records were registered centrally before county clerks and health departments began issuing copies locally. The state fee is $14 for the first copy and $11 for each additional copy of the same record, as set by RSMo 193.265.

Under RSMo 193.255, only those with a direct and tangible interest can receive certified copies of death certificates less than 50 years old. Eligible parties include a spouse, parents, children, siblings, grandparents, grandchildren, aunts, uncles, nieces, and nephews of the person named on the record. Legal representatives and those with documented property or estate interests also qualify. After 50 years, under RSMo 193.225, records transfer to the State Archives and become open to the public at no cost.

Benton County Death Index in the Missouri State Archives

The Missouri State Archives has more than 2.5 million digitized death certificates from 1910 through 1975. Benton County death records from this period are free to search through the Archives Death Certificates portal. You can search by first name, last name, county of death, and year or month. For deaths from 1954 through 1975, the database also accepts searches by the name of a surviving spouse, father, or mother. This feature helps when you know a relative's name but not the name of the deceased. Each digitized certificate includes the decedent's full name, date and place of death, birth date and state, parents' names, spouse, occupation, cause of death, attending physician, funeral home, and burial location. Under RSMo 193.145, all new Missouri death certificates are now filed through the MoEVR electronic system before becoming accessible through official channels.

Benton County was organized in 1835, giving it a long history before state registration began in 1910. For deaths before that year, the Missouri Birth and Death Records Database, Pre-1910 indexes microfilmed records from the 1883 to 1893 registration period. Benton County's pre-1910 records may be incomplete, as early registration efforts in rural Missouri varied by county. Probate court files, church records, and cemetery transcriptions can help fill gaps for this period.

The FamilySearch Benton County genealogy page lists what collections exist for the county, including those held at the Benton County Courthouse in Warsaw and at FamilySearch partner libraries. This page is a useful reference before you drive to Warsaw or mail a request to the Clerk's office.

What Benton County Death Records Include

A certified Benton County death certificate lists the decedent's full legal name, date and place of death, date and state of birth, sex, race, marital status, and occupation. It also shows both parents' names including the mother's maiden name, the surviving spouse's name, cause of death and contributing conditions, the name of the attending physician or coroner, funeral home information, and burial location. The person who provided information at the time of registration is also identified on the form. If you need the long form certificate with full medical certification language, that version comes only from the state Bureau in Jefferson City. Note that option on your application when you order.

Records from 1910 to 1975 in the State Archives database have the same basic fields, though certificates from earlier decades tend to have fewer details because the forms in use were simpler. Medical terms on older records can be hard to interpret. The Archives publishes a medical terminology guide and a historical cause-of-death reference that helps researchers make sense of older language. Terms like "marasmus," "dropsy," and "putrid fever" are defined in those tools.

Certified copies of death certificates less than 50 years old are restricted to those who qualify under RSMo 193.255. For older records, anyone can access the Archives database at no charge. No proof of relationship is required for records more than 50 years old.
